In the event of a conflict between this Disclaimer and the Terms of Service for purchases made at xnor.shop, the Terms of Service prevail.

Safety Warning#

Modifying any vehicle, and connecting additional hardware or software to a vehicle, are activities that carry inherent risks. Improper use can cause loss of vehicle control, vehicle damage, property damage, serious injury, or death. Do not modify your vehicle unless you fully understand and accept those risks. You alone are ultimately responsible for any modifications you make — not xnor GmbH (operating xnor.shop), its owners, contributors, affiliates, comma.ai, any vehicle manufacturer, or anyone else.

You must remain attentive and in full control of your vehicle at all times — hands on the wheel, eyes on the road, ready to disengage. No hardware or software referenced on this site is a substitute for an attentive driver. Advanced driver assistance systems (ADAS) are not autonomous driving systems.

You are solely responsible for understanding and complying with all applicable local, national, and international laws and regulations in your jurisdiction. This includes, without limitation and where applicable, the German Straßenverkehrs-Zulassungs-Ordnung (StVZO), the Straßenverkehrsordnung (StVO), EU Regulation 2018/858 and related UN/ECE regulations, and any equivalent or successor rules in other jurisdictions, covering in particular:

  • Vehicle modification and roadworthiness requirements
  • Type approval and homologation regulations
  • Use of advanced driver assistance systems on public roads
  • Insurance requirements and implications of vehicle modifications
  • Data privacy, telemetry, and recording laws

Laws regarding vehicle modifications and ADAS vary significantly between countries, states, and regions. What is permissible in one jurisdiction may be illegal in another. It is your obligation to verify legality, insurance coverage, and warranty impact before purchasing, installing, or using any product or software referenced on this site.

Hardware#

xnor GmbH, operating the xnor.shop online store, sells hardware accessories (harnesses, adapters, cables, connectors, and related components) that can be used to interface between comma devices and vehicles. These are general-purpose electronic interface components sold for research, development, prototyping, educational, and experimental purposes. They are not sold as, and are not intended to be, certified automotive safety equipment, type-approved components, original-equipment replacement parts, or replacements for manufacturer-installed vehicle systems. xnor GmbH is not affiliated with, endorsed by, or sponsored by any vehicle manufacturer.

  • The purchase of hardware does not include any software license, software support, or guarantee of software compatibility with current or future updates.
  • All hardware is sold subject to the warranty disclaimers and limitations set out in the Terms of Service, in particular Section 5 and Section 16. Mandatory statutory consumer warranty rights under German law (Sec. 434 et seq. BGB) and comparable mandatory consumer protection laws remain unaffected.
  • xnor GmbH makes no representation whatsoever that its hardware is street-legal, road-approved, type-approved, or otherwise lawful to install or operate on public roads in any particular jurisdiction.

Software#

xnor GmbH does not develop, sell, or distribute openpilot or any driving software as part of the purchase contract for hardware. openpilot is an open-source project maintained by comma.ai and its community contributors. The xnor fork of openpilot is a community-maintained branch that is made available, entirely independently of the sale of hardware and outside the scope of any purchase contract, under its applicable open-source license, free of charge, “as-is” and without warranty of any kind.

openpilot is released under the MIT license. Some parts of the software are released under other licenses as specified in the project. The buyer’s decision to download, install, or use any such software is made independently by the buyer, under the terms of the applicable open-source license, and is not part of any purchase contract with xnor GmbH. xnor GmbH provides no warranty, support, maintenance obligation, fitness-for-purpose guarantee, or road-legality representation in respect of any such software, whether authored or maintained by xnor GmbH, its owners, employees, or third parties.

As required by the upstream openpilot license, any user of openpilot shall indemnify and hold harmless comma.ai, Inc. and its directors, officers, employees, agents, stockholders, affiliates, subcontractors and customers from and against all allegations, claims, actions, suits, demands, damages, liabilities, obligations, losses, settlements, judgments, costs and expenses (including without limitation attorneys’ fees and costs) which arise out of, relate to or result from any use of this software by user.

Limitation of Liability#

To the fullest extent permitted by applicable law, xnor GmbH, its owners, operators, contributors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, fines, penalties, loss of insurance coverage, loss of warranty, accidents, personal injury, death, or property damage arising out of or in connection with:

  • the purchase, installation, or use of any hardware sold by xnor GmbH;
  • the user’s independent choice of software, firmware, or system to use with such hardware;
  • the user’s failure to comply with applicable laws, regulations, or insurance requirements; or
  • any use of, or inability to use, any products, software, or information provided on this site.

This limitation applies regardless of the legal theory under which liability is claimed, whether in contract, tort (including negligence), strict liability or otherwise.

Mandatory statutory liability remains unaffected, including (where applicable) liability under the German Produkthaftungsgesetz, liability for intent and gross negligence, liability for the breach of essential contractual obligations (Kardinalpflichten), and liability for injury to life, body or health.

Indemnification#

This Section applies only to users acting in the course of their trade, business, profession, or craft (B2B). Consumers within the meaning of Sec. 13 of the German Civil Code (BGB) are not subject to this indemnification obligation; the statutory rules apply to them.

By using this website, purchasing hardware from xnor.shop, or using any software referenced herein in a non-consumer capacity, you agree to indemnify, defend, and hold harmless xnor GmbH, its owners, operators, contributors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to your use of any products, software, or information provided.

Severability#

If any provision of this Disclaimer is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Governing Law#

This Disclaimer shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and excluding the conflict-of-laws rules. For consumers within the meaning of Sec. 13 BGB, this choice of law shall not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence (Art. 6 Rome I Regulation (EC) No. 593/2008). For merchants (Kaufleute), legal entities under public law, or special funds under public law, the exclusive place of jurisdiction for all disputes arising out of or in connection with this Disclaimer shall be the courts in Frankfurt am Main, Germany.
